MEDIA RELEASE, 26 MARCH 2013, NEW DELHI

Lok Satta Party alongwith its alliance partners Lokraj Sanghathan and Naya Daur Party under the banner of Lokraj Democratic Alliance(LDA) met Shri Rakesh Mehta, State Election Commissioner and submitted a representation again to ascertain action taken by them against violations committed during MCD elections.

Lok Satta Party had filed a PIL and Writ Petition in High Court where the court and Counsel for State Election Commission made the following remark:

“Counsel submits that whenever the violations are either noticed or brought to the notice of the State Election Commission, the Commission would immediately direct the concerned police station having jurisdiction of the area to take cognizance of the same and register the FIR.

As far as the police is concerned, as per the instructions issued in respect of the posters, banners etc., the same are in tune with the code of State Election Commission and whenever such violations are noticed, they should certainly take appropriate action in accordance with law.

Except producing certain banners and posters to sustain the plea in the writ petition, the relief appears to be general in nature. So long as the code issued for the fair and free election, particularly, with regard to putting up of banners and posters issued by the State Election Commission and similar instructions issued by the Delhi Police are there in the book, they should be acted upon and wherever violations are noticed, necessary action is required to be taken by the State Election Commission and the Police concerned in accordance with law.”

LSP made a representation again to the SEC with no result and in the Write petition filed before high court again counsel for SEC responded that they had not replied to the representation and would make a suitable reply.

We have also petitioned that SEC should take action against the officials who do not perform satisfactorily or are found to be delinquent in discharging their duties during MCD elections should be punished as per law; and/or heavily fined upto 6 months of their salary & also demoted by one level which will act as a strong deterrent for all officials connected with conducting free and fair elections

Today LDA again met the State Election Commissioner to ascertain what action has been initiated against violations and SEC was non-committal since violations are majorly committed by the large parties viz. Congress & BJP who are their masters and they do not have the courage to take action.
